Terms of service

Plain-English rules for using SESMetric. The short version: send only to people who asked to hear from you. Transactional and marketing mail run on separate infrastructure; spam gets you banned either way.

1. Acceptable use

SESMetric carries two kinds of mail on separate infrastructure: transactional messages (tied to an action the recipient took) and marketing campaigns (via the Campaigns product, only to contacts who opted in, from a verified domain you control). Consent is the line — every recipient must have asked to hear from you.

Allowed

  • Receipts, invoices, order confirmations
  • Password resets, magic links, OTPs
  • System alerts, security notices, account updates
  • Newsletters and campaigns to opted-in contacts (Campaigns product)
  • Drip sequences to contacts who signed up for them

Prohibited

  • Cold outreach, prospecting, lead-generation
  • Any list sourced from purchase or scraping
  • Marketing content on the transactional API/SMTP path
  • Removing or defeating unsubscribe links
  • Content that violates CAN-SPAM / GDPR / local law

Enforcement

Accounts sending to purchased, scraped, or non-consenting lists — on either path — will be immediately suspended without notice and assessed a $500 cleanup penalty plus any deliverability remediation costs we incur with upstream providers. Repeat violations result in permanent ban and forfeiture of prepaid balances.

Marketing campaigns must go through the Campaigns product: it runs on an isolated IP pool, requires a verified domain identity, enforces one-click unsubscribe on every message, and applies bounce/complaint suppression automatically. We monitor send shapes and complaint rates on both paths and reserve the right to inspect sending content when a pattern is flagged.

2. The service

SESMetric provides a transactional email API, SMTP relay, and a dashboard for managing sending identities, templates, and events. We deliver mail through reputable upstream providers; downtime in those providers may surface in our service. We publish operational status at sesmetric.com/status.

3. Billing & payments

Paid plans renew automatically until canceled. Cancellation stops future renewals; current billing periods are not pro-rated. Failed payments place the account in a grace period; after seven days we may suspend sending. Refunds are evaluated case-by-case and are not issued for usage already consumed.

4. Your responsibilities

You are responsible for the content you send, the recipient lists you upload, and the credentials you issue from your account. You must keep DKIM, SPF, and DMARC alignment on your sending domains and respond to bounces and complaints. You may not resell access without a written agreement.

5. Intellectual property

You retain ownership of message content, templates, and lists you upload. We retain ownership of the platform, code, brand, and dashboards. Feedback you give us is non-confidential and we may use it without restriction.

6. Disclaimers & liability

The service is provided "as is." We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement to the maximum extent allowed by law. Aggregate liability is capped at the amount you paid us in the prior twelve months.

7. Termination

You may close your account at any time from /dashboard/settings. We may suspend or terminate accounts that violate these terms, fail payment after the grace period, or pose a security or deliverability risk. On termination, sending stops immediately; account data is retained for 30 days then deleted.

8. Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Wilmington, Delaware.
